1. General Terms & Conditions

IMS Landscape & Hardscape Inc. ("Company") agrees to provide landscape and hardscape services as described in written proposals or contracts. By accepting our services, the client ("Client") acknowledges and agrees to abide by these terms and conditions. We reserve the right to update these terms at any time without notice. Service areas include Massachusetts, Connecticut, and Rhode Island. All work will be performed as outlined in the project agreement. No verbal modifications are valid unless confirmed in writing.

2. Service Terms

Services provided will be as described in the approved proposal. Any additional services or materials must be requested and approved in writing through a change order. Timelines are estimated and may be impacted by weather, material availability, or unforeseen site conditions. We commit to high-quality workmanship and clear communication throughout the project duration. All work is performed to industry standards and local code requirements.

3. Payment Terms

A 50% deposit is required before work begins unless otherwise agreed in writing. Progress payments may be required for larger jobs, with final payment due upon project completion. Late payments may incur a 5% monthly late fee. Payments are accepted via check, ACH, Zelle, or other approved methods. We do not offer refunds. However, we will fix any issues caused by our team at no additional cost to the client.

4. Change Order Policy

Any change to the original scope of work must be submitted in writing by the client and approved by the company. Change orders may affect the total cost and completion timeline of the project. Additional work will not commence until the change order is signed and any applicable fees are paid. Verbal requests will not be honored.

5. Cancellation & Rescheduling

Clients may cancel or reschedule a project by providing at least 48 hours’ notice. Cancellations made after this window may result in forfeiture of the initial deposit. Weather-related delays are outside of our control and will result in rescheduling at the earliest possible date. The company reserves the right to reschedule or pause work due to unsafe site conditions or non-payment.

6. Damage & Liability

We are not responsible for damage to unmarked underground utilities, irrigation systems, or other hidden objects. Clients must inform us of all underground features before work begins. IMS Landscape is not liable for damage caused by third parties, weather conditions, or lack of proper care post-installation. We carry general liability insurance and strive to prevent damage to existing structures and landscaping.

7. Client Responsibilities

Clients must ensure access to the worksite during normal business hours. All pets must be secured, and irrigation systems should be turned off before work begins. Clients are responsible for securing any necessary permits unless stated otherwise. Clients must also approve any design or layout changes promptly to avoid project delays.

8. Photo/Marketing Use Disclaimer

IMS Landscape reserves the right to photograph completed work and use such images in marketing materials, including our website, social media, and promotional content. If the client does not wish for images of their property to be used, they must submit this request in writing before project completion.

9. Governing Law

These Terms & Conditions are governed by the laws of the Commonwealth of Massachusetts. Any disputes arising from services provided by IMS Landscape & Hardscape Inc. shall be resolved in a court located in the state of Massachusetts.
